1.2 These Terms and Conditions govern the supply of any Product ordered by you on the Site. By ordering a Product, you agree to be legally bound by these Terms and Conditions.
1.3 In these Terms and Conditions:

- “Acknowledgment” means our acknowledgment of your order by email.
- “Contract” means your order of a Product that we accept in accordance with these Terms and Conditions.
- “Customer” means the individual who places an order on the Site.
- “Order” means the order submitted by you to purchase a Product from us.
- “You” refers to the customer who places an order.
2. Your Status
By placing an order through the Site, you warrant that you are legally capable of entering into binding contracts and that you are at least 18 years old.
3. Effect
3.1 These Terms and Conditions apply to all orders made by us for the sale of Products. By submitting an order, providing delivery instructions, or accepting delivery, you agree to these Terms and Conditions.
3.2 These Terms and Conditions supersede any separate terms submitted by you, unless agreed in writing by us.
4. How a Contract is Formed
4.1 To place an order, you must follow the instructions on the Site, including registering for an Account.
4.2 Prices displayed on the Site are in US dollars (USD) unless otherwise stated. All charges, including applicable taxes and delivery costs, will be listed prior to submitting your order.
4.3 You agree to pay for the Products in full at the time of ordering. We accept payments through credit or debit cards and other methods indicated on the Site. If payment is declined, we reserve the right to cancel the order.
4.4 If we cannot accept your order, we will notify you and will not charge you. Reasons may include Product unavailability or issues with payment authorization.
4.5 A Contract is formed when we accept your order and send a confirmation email.
5. Delivery
5.1 We will deliver the Products to the address specified in your order. Delivery times are estimates, and while we strive to meet our estimated delivery dates, we cannot guarantee them.
5.2 We deliver only to the contiguous United States. We do not currently ship to Alaska, Hawaii and Puerto Rico. Shipping times may vary based on your location.
5.3 Title to and risk of loss for the Products pass to you upon delivery.
6. Cancellations
6.1 We reserve the right to cancel your order if the Product is unavailable. In such cases, we will notify you and refund any payment.
6.2 If you wish to cancel an order before shipment, please contact us at support@marie-jose.com as soon as possible. If the order has already been shipped, you may need to return the Product as outlined in Section 7.
7. Returns and Refunds
7.1 Non-Faulty Products: If you are unsatisfied with a Product, you may return it within 30 days of delivery. The Product must be unused, in its original packaging, and in the same condition you received it. You are responsible for return shipping costs unless the return is due to a Product defect.
7.2 To initiate a return, please visit our "Returns" page and follow the instructions. Upon receipt and inspection of the returned Product, we will issue a refund within 14 business days.
7.3 Faulty Products: If the Product is defective or damaged, you must notify us within 7 days of delivery. We may request you return the Product for inspection. If confirmed defective, we will replace the Product or issue a full refund, including shipping costs.
8. Limitation of Liability
8.1 We warrant that the Products will be of satisfactory quality and fit for their intended purpose as per the manufacturer’s specifications.
8.2 To the maximum extent permitted by law, we are not liable for:
- Loss of revenue, profits, or business;
- Indirect or consequential losses, damages, or expenses.
8.3 Our total liability to you for any loss or damage arising in connection with your order shall not exceed the amount paid for the Products.

11.1 These Terms and Conditions are governed by and construed in accordance with the laws of the United States and the State of Illinois, without regard to its conflict of law provisions.
11.2 Any disputes arising out of or related to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts located in The Netherlands.
